These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with https://edorams.com website (the “Service”) operated by Edora MS (“us”, “we”, or “our”). Please read these Terms and Conditions carefully before using the Service.

 

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms & Conditions as well as Privacy Policy. These Terms apply to all visitors, users and others who access or use the Service.

 

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

 

You confirm that you are 18 years old. If you are under 18, you are not allowed to use the services of the site. If you are under 18, the registration on the site and/or purchase of sheet music (tablature, tabs), as well as booking and payment of Lessons, should be carried out by your parents or guardians. If your parents (or guardians) do not agree with at least one of the clauses of these conditions, you should immediately stop using the services of our site.

 

1. Purchases

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.
We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.
We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

2. Guitar Transcription and Arrangement Refund Policy

We do not issue refunds for guitar transcription and arrangement once the payment is confirmed. We can only issue a refund if we fail to deliver the order on time. In such a case we provide a 100% money-back via PayPal, which usually takes five to seven business days.

If for some reason you are not satisfied with your arrangement/transcription, we will revise it and send you an updated version until it is 100% accurate and you are happy with it. Please note that you can claim a free revision only once and within 48 hours of the delivery time. If you fail to contact us within 48 hours, the arrangement/transaction will be considered done, and no revisions will be made later.

All video links will be available on Google drive for two weeks only. You are responsible for making backups of your files. Be sure to save all the files (guitar tab, sheet music, project files, audio, video) on your computer. If you have lost your copies, you will have to buy new ones.

3. Availability, Errors, and Inaccuracies

We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other websites.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

4. Contests, Giveaways and Promotions

Any contests, giveaways or other promotions (collectively, “Promotions”) made available through the Service may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

5. Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity, or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

6. Intellectual Property

The Service and its original content, products, services, information, features, and functionality are and will remain the exclusive property of Daria Petrova. The Service has the following content: visual interfaces, interactive features, information, graphic, services, design, sheet music, tablatures (tabs), products, video, software. You do not have the right to copy, correct, publish, transmit, distribute, display, sell, execute/use (with the exception of the content provided with the license agreement) any information or content of this site. The Service is protected by copyright, trademark, and other laws of both Ukraine and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Daria Petrova.
If you are the owner of the copyright content, or its official representative and consider that any content posted on the edorams.com website violates your copyright, contact us by e-mail. A complaint can be sent to info@edorams.com with an explanation, as well as all documentation confirming the copyright to the claimed content.

7. Lesson policies

7.1. By agreeing to these conditions, you confirm that you will not provide any financial or personal information to the teachers, transfer or assign lessons, or pay for the educational services provided directly to the teacher without prior notice to the school administration. All lessons are taught by teachers of the Edora MS online through Skype video call and only using the Skype accounts of the School (live:edora_music_school; live:edora_music_school1). The teachers of the Edora MS are official employees of the school and have no right to conduct online classes in any other way than those indicated above. In cases of violations of these rules, information on violations may be communicated to the competent authorities and have legal consequences.
7.2. In cases of violations or repeated cancellation of lessons without notifying the administration, we reserve the right to deprive you of access to the services of the site. The school administration is entitled to apply any legal and technical remedies to prevent violation of this agreement.
7.3. Recorded Lessons. The online lessons taught by the school’s teachers are the intellectual property of the Edora MS. You may not use third-party software to record a Lesson or publish an audio/video recording of a lesson with the participation of teachers of the Edora MS on audio and video hosting or other various sites. Edora MS reserves the right to record a video/audio of the Lesson, but only in cases of mutual consent of the student and the teacher. Such videos can be used to popularize the school and can only be posted on edorams.com and/or on the official Edora MS channel on YouTube. Permission to record a Lesson should be voiced verbally by both the teacher and the student during the recording of the video of the lesson. Edora MS reserves all rights to video/audio recordings of the Lessons.
7.4. Edora MS is not responsible for and does not compensate for damages caused by any errors, omissions, or negligence of teachers.
7.5. Parents (or guardians) have the right to attend the Lessons of their children without prior notice and at no extra charge.

8. Lesson Cancellation Policy

Cancellations must be made at least 48 hours before the appointed time. To cancel your lesson, please contact us by e-mail at info@edorams.com. If you reach us less than 48 hours before the actual lesson time, we will charge the full price of the lesson. If you decide to take a break from the training, all the unused lessons will be valid for four months, and at any convenient time, you can resume your studies in our school (unused lessons after this period will be deemed cancelled with no refund).
If the teaching style does not suit you, and you do not want to continue studying at our school, you must cancel the next lesson at least 48 hours before the appointed time, and we will refund unused lessons of a package.
Refunds for canceled lessons will be made through PayPal, which usually takes from five to seven working days. Please note that the money back guarantee does not cover the PayPal money transfer fee.

9. Lesson canceled by the school

Sometimes in case of unpredictable emergency or sickness, there is no other option but to cancel a lesson. If such a situation happens, the student will be notified by e-mail. You will also be offered a chance to re-schedule the lesson for a convenient day and time. Edora MS does not charge any additional fees for rescheduling.

10. Rescheduling a lesson

10.1. Rescheduling before the lesson. If you do need to reschedule a lesson for another day or time, contact us by email at least 24 hours before the actual lesson time. In the text of the message specify the reasons why you cannot attend your lesson and indicate the preferred new day and time (specify several possible dates to facilitate the search of the suitable date). Rescheduling is completely free. Note that you can reschedule the same lesson only once. If the lesson is rescheduled, but the student did not appear online at the appointed time, such a lesson is considered as taken place, and the payment will not be refunded. All the timetable changes should be carried out only through the Edora MS administration and not with the teacher directly.
10.2. Rescheduling after the lesson. If your teacher did not show up for the lesson, or the lesson did not take place because of poor Internet connection from the teacher’s side, you will be asked to reschedule the lesson for any day and time convenient for you. If you do not wish to reschedule a lesson and want to request a refund, please contact us via email at info@edorams.com. Please note that you can request a refund for a lesson that did not take place due to the Edora MS teacher’s fault within 48 hours from the actual lesson time.

11. Refund for Failed Lesson

If the lesson was not completed due to lack of or poor Internet connection from the side of the teacher of Edora MS (the teacher was absent at the scheduled time, poor Internet connection, or other connection issues from the teacher’s side, etc.) and you do not wish to reschedule it, we guarantee a 100% refund of the lesson’s cost. All such situations, as well as discussion about the refund for a lesson, will be conducted on a case-by-case basis. Please contact us via email at info@edorams.com. In the body of the message, specify the date of the lesson, the teacher’s name, and the reason why your lesson did not take place. If you are certain that the problem occurred from the teacher’s side, please include in your email screenshot with your Internet speed from speedtest.net. Make sure your screenshot indicates day and time which corresponds to the time and date of the failed Lesson. Note that you can request a refund for a lesson that did not take place due to the Edora MS teacher’s fault within 48 hours from the actual lesson time. If you fail to contact us within 48 hours, such a lesson will be considered as taken place, and the money will not be refunded.
We do not refund for a lesson that did not take place due to the student’s fault. This includes if the student was not online at the appointed time, there was no or poor Internet connection from the student’s side, etc.
Refunds for failed or canceled lessons will be made through PayPal, which usually takes from five to seven working days. Please note that the 100% money back guarantee does not cover the PayPal money transfer fee.
The teacher will wait online on Skype for 20 minutes from the beginning of the lesson. If the student does not show up within this time, the lesson will be considered to have taken place, and the money will not be refunded.

12. Links to Other Web Sites

Our Service may contain links to third-party websites or services that are not owned or controlled by Edora MS.
Edora MS has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Edora MS shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

13. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

14. Limitation of Liability

In no event shall Edora MS, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

15. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Edora MS its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components, or d) the results of using the Service will meet your requirements.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.
You undertake to pay any damages to all members, officials, partners, and school staff in the event of violation of these conditions. We own the copyright of a) the intellectual property of the site, b) the personal content of teachers, and c) any materials that the teacher provides you (including exercises, sheet music, scores, notes, tabs, chords, etc.). We undertake to notify you of any actions and legal proceedings, if any, concerning you.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.

17. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is a material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
